1. Acceptance of Terms

By accessing and using FlowTest Pro ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

FlowTest Pro provides a web-based platform for creating, managing, and generating PDF reports for fire hydrant flow tests. The Service includes:

• Flow test data entry and calculation tools
• GPS mapping and elevation services
• PDF report generation with company branding
• Cloud-based access to your flow test data

3. Account Registration

To use the Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your password
• Be at least 18 years of age
• Be authorized to enter into this agreement

You are responsible for all activities that occur under your account.

4. Subscription and Billing

Free Trial: New users receive a 7-day free trial. Your payment method will be charged $30 USD after the trial period ends unless you cancel.

Monthly Subscription: After the trial, you will be charged $30 USD per month. Subscription automatically renews each month.

Cancellation: You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period. No refunds are provided for partial months.

Price Changes: We reserve the right to change our prices with 30 days' notice to active subscribers.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Share your account credentials with others
• Use the Service to store or transmit malicious code
• Reverse engineer or attempt to extract source code

6. Data Ownership and License

Your Data: You retain all ownership rights to the data you enter into the Service (flow test data, project information, etc.).

License to Us: You grant us a limited license to use your data solely to provide the Service, including generating PDF reports.

Our Property: The Service, including all software, designs, and trademarks, remains our exclusive property.

7. Data Accuracy and Professional Use

No Warranty: FlowTest Pro is a tool for creating reports. We do not warrant the accuracy of calculations or data. You are solely responsible for verifying all data and calculations.

Professional Responsibility: This Service is a tool to assist professionals. It does not replace professional judgment or expertise in fire protection engineering.

Elevation Data: GPS elevation data is approximate and should be verified for critical applications.

8. Service Availability

We strive to provide reliable Service, but we do not guarantee:

• Uninterrupted access
• Error-free operation
• That the Service will meet your specific requirements

We reserve the right to modify or discontinue the Service with reasonable notice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• FlowTest Pro is provided "AS IS" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid in the last 12 months
• We are not responsible for errors in your flow test data or reports

10. Indemnification

You agree to indemnify and hold FlowTest Pro harmless from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Reliance on reports generated by the Service

11. Data Retention and Deletion

Upon cancellation:

• You will have 30 days to export your data
• After 30 days, we will permanently delete your account and data
• You may request immediate deletion by contacting us

12. Intellectual Property

You may not:

• Copy, modify, or distribute our software
• Create derivative works based on the Service
• Remove any copyright or proprietary notices

13. Third-Party Services

The Service integrates with third-party services (Stripe for payments, Google Maps for location data). Your use of these services is subject to their respective terms and policies.

14. Termination

We may suspend or terminate your account if:

• You violate these Terms
• Your payment fails
• We discontinue the Service

You may terminate your account at any time by canceling your subscription.

15. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes via email. Continued use of the Service after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict of law provisions.

17. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Arizona, except that either party may seek injunctive relief in court.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FlowTest Pro.
